That depends entirely on the law enforcement or medical agency in question. In Los Angeles law enforcement, you are given every opportunity to tell the truth up front and they decide if you would be a good risk. A background check will reveal all criminal history to include dismissed charges. You will be polygraphed, so tell everything. Withholding any info can result in not only disqualification from the agency you are applying for, but a permanent label as an integrity violator. No one wants to hire a liar. My best advice is to apply and see what happens. The worst they can do is say no.
